1. Acceptance

School Wale is provided by Arkas Labs ("we", "us", "our"). By using this website or the School Wale service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them.

If a school has signed a separate agreement or order with us, that agreement takes priority over these terms where they differ.

2. The service

School Wale is cloud software that helps schools manage students, admissions, attendance, homework, examinations, fees, staff, library, calendar, reports and communication with parents, through a web application and a mobile app.

Demos are free and carry no obligation. We may add, change or remove features over time and will tell schools about significant changes.

3. Who can use it

The service is offered to schools and educational institutions. Staff, parents and students may use it only through an account created by their school. Students under 18 should use it under the supervision of a parent or guardian, as arranged by the school.

4. Accounts and security

Keep your login details private and do not share accounts
The school is responsible for creating, managing and removing user accounts and their roles
Tell us or your school straight away if you suspect someone else has used your account, at info@schoolwale.co.in

5. Acceptable use

You must not:

Access data you are not authorised to see, or try to get around security controls
Upload unlawful, harmful or offensive content, or malware
Copy, scrape, resell or reverse-engineer the software
Overload or disrupt the service, or use it in a way that breaks any law

We may suspend accounts that break these rules.

6. School data

Schools own the data they enter into School Wale.
The school is the Data Fiduciary for this data and is responsible for having a lawful basis to collect it, including verifiable parental consent for students under 18.
We process school data only to provide the service, on the school's instructions, as described in our Privacy Policy.
School data is stored on servers in Mumbai, India.

7. Fees and payment

We do not take payments on this website. Subscription fees, billing periods and payment terms are agreed in writing with each school, and invoices include applicable taxes such as GST. Fees paid are not refundable unless the school's agreement says otherwise.

8. Intellectual property

The School Wale software, website, name, logo and content belong to Arkas Labs. A school subscription gives the school and its authorised users a limited, non-transferable right to use the service for the school's own purposes during the subscription.

9. Availability and support

We work to keep the service available and secure, but we do not promise it will be uninterrupted or error free. We may carry out planned maintenance, and will try to schedule it outside school hours. Support is available by email and phone.

10. Liability

The service is provided "as is". As far as the law allows, we are not liable for indirect or consequential losses, such as loss of profit or goodwill. Our total liability for any claim is limited to the fees the school paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Termination

A school may stop using the service as set out in its agreement. We may suspend or end access for serious or repeated breach of these terms. When an account ends, the school can ask for an export of its data, after which we delete it as described in our Privacy Policy.

12. Governing law

These terms are governed by the laws of India. We will first try to resolve any dispute through discussion. Any dispute that cannot be resolved that way will be subject to the jurisdiction of the competent courts in India.

13. Changes to these terms

We may update these terms from time to time. We will change the "Last updated" date at the top of this page and tell schools about important changes. Continuing to use the service after a change means you accept the updated terms.
